Important Note Please Read:
Due to many email spam filters and blockers set up everywhere on the Internet, it is no longer possible for any one to guarantee that emails will arrive at their destination. The order confirmation that you will get is an automated response for your records.. It does not mean that we have received your order. Please track the status of your order. We will always send an additional confirmation that your order is being processed. In the unlikely event that we have not responded to your order with an eMail within 3 working days, please call us to check the progress of your order. 

International & European Deliveries:
No shipping charges are added during checkout. We will calculate shipping charges manually.
We will inform you by eMail about shipping charges before we process your order and/or take payment from you. This gives you the chance to cancel your order. 
Most destinations outside the European Union won't have to pay UK sales TAX (currently at 17.5%).
If this is the case we will recalculate the total of your order.
Please note that you might have to pay import or other taxes when importing goods form the United Kingdom

Terms & Conditions (January 2008)

Visitors to our Web site are required to accept the following terms and conditions in return for the information given about us, our business and the services we provide through our Web site.

 

1. All orders placed are subject to stock being available. Items that can be added to the shopping basket are usually in stock. If any item is out of stock, it will be sent as soon as possible. If there is likely to be a long delay (5 days), we will endeavour to contact you to advise you of this. If an item becomes unavailable, we will contact you regarding alternatives and give you the opportunity to cancel the original order. We will not take any payment on your credit/debit card until the order is ready for dispatch.

2. Order Acceptance - the receipt of the automated order confirmation does not constitute the acceptance of an order, or confirmation of an offer to sell. Should your order status not change and/or you have not received a message from us within 48 hours of placing your order we advice you to call us.

3. Any claims for damage, faults and miss-shipped items must be made within 7 working days of receipt of goods. Write to the address below or eMail to info@kitesandmore.co.uk

4. If you are a consumer you have the right to withdraw your order for goods before they are shipped and also within 7 working days of the goods being received. This does not apply to items personalised or items made to your specification (i.e. a kite with your name or logo, kite line or line sets ordered to your specifications), kite videos and DVDs, kite related software, books and magazines. We will only accept unwanted products for refund provided that the goods are complete with all relevant packaging in an unused, unopened and re-saleable condition. A copy of the original invoice/receipt must be provided. You must inform us in writing of your desire to cancel within seven working days starting on the day after the day the goods are delivered to you. You must return the goods to us at your cost and we advise you to ensure that the goods are adequately insured during any return journey and that a signature is given by us as proof of receipt. If requested we can arrange for goods to be collected from you. Please note that you will be charged for this.

We shall refund the total amount of money paid by you for the goods (shipping or any other charges to you are non-refundable) and also less any costs to collect the goods if required.
Note:  If the goods were shipped to you FREE of charge, than we will deduct our postage/shipping cost to you from your refund. 

The only circumstance in which you cannot withdraw your order is where you have used, altered or damaged the goods which you have already received. You do require a valid returns number before goods can be returned. Please note your right to cancel does not apply to customised kites, kite related Software, Videos, DVDs, Magazines or Books.

5. The privacy and confidentiality of your personal information is important to us. Therefore, it is our policy not to disclose or sell this information regarding your orders and products you purchase to any outside organisation. EMKAY may use such information to communicate special promotions and offers to you by email or post, unless you notify us that you do not want to receive such communications.


6. EU residents pay VAT (@17.5%) inclusive price. Non EU/Exempt pay the exclusive price. EMKAY is not liable for any customs or import duties that might be incurred when the goods are shipped to your destination. It might not be possible for us to deliver to certain locations.

7. All goods remain the property of
EMKAY until paid for in full. Risk passes to yourself on delivery.

8. Goods are not supplied on a trial basis.

 

9. Warranty:  Our products are covered by the manufacturers warranty against manufacturing defects or faults. We know that kites, kite lines and other kite related products can break when used and operated outside the manufacturers recommended wind conditions or the product's intended purpose. We are unable to give a refund, free exchange or free repair if in our or the manufacturer's judgement damage was caused by an accident or misuse of the product. However should you crash and damage your kite, we will be able to help in most cases to get you flying again. Please get in touch. 

10. All prices and offers are subject to change and availability. Errors and omissions excepted. Subject to not selling below our cost price. VAT will be charged on all prices (including delivery) at a rate of 17.5% for deliveries to UK and other European  destinations. Allow up to ten working days for cheque clearance. For out of stock items, delivery dates given are only estimates. Credit card statements show payment made to EMKAY.

11. These terms and conditions do not affect your consumer statutory rights.

Business Customers

Business customers can call us for a copy of our latest business catalogue.

If you are a business or if the goods are used wholly or in part for business purposes we shall not be liable to you for any business loss including loss of profits (whether direct or indirect) business data, revenue, goodwill, or incidental, or consequential loss that you may suffer as a result of the purchase of goods from us. Any other liability shall be limited to the price paid for the goods.  Returns are subject to a 10% handling fee. You will not export any goods purchased from us in contravention of United States of America export controls.



Returns Procedure

We check the goods before they are shipped in order to minimise any potential faults to lessen any inconvenience to you. However if you do believe that a product sent to be faulty or incomplete please call or email for a solution.

We can often resolve the problem over the phone or give adequate advice so there will be no need to return the product. Upon contacting
EMKAY and if the problem cannot be resolved over the phone or by eMail, we will give a returns number and also a returns address (can be different to our contact address) to get the item returned. Please make sure that you adequately insure the item and receive proof of shipment (Royal Mail signed for). Items with a value of  more than £34 are best send insured Royal (Mail Special Delivery or by insured Standard Parcel).


When we receive your goods we will check them and if faulty we will get a replacement send to you as soon as possible.


If we cannot see any fault or it is unclear we will contact you to discuss the problem further, therefore please make sure you give us a contact telephone number and eMail address.


Note: The goods must be returned in their original condition (unused and undamaged as if fit for resale, with all documentation, original packing intact and a copy of the original invoice/receipt.
